Project Design: Four Specific Objectives

Specific Objective 1

To support capacity building of the HJC and consolidation of the process of career development system for judges based on meritocracy and transparent proceedings in line with the European standards and the best practices as well as the strengthening of the functional and organisational independence, transparency, efficiency and effectiveness of the courts in accordance with the law.

Specific Objective 2:

To support capacity building of the HPC and consolidation of the process of career development system for prosecutors based on meritocracy and transparent proceedings in line with the European standards.

Specific Objective 3:

To support capacity building of the HJI and consolidation of the disciplinary investigation based on meritocracy and transparent proceedings in line with the European standards and the best practices.

Specific Objective 4:

To support the governance institutions in building their co-ordination and cooperation capacities in line with the European standards and the best practices.

VISION & MISSION

On 25 March 2020, the Council of the European Union decided to open accession negotiations with Albania. The Council mandated the Commission to report on a number of issues to be addressed by Albania prior to the first Inter-Governmental Conference on accession negotiations. Following this decision, the Council approved on 18 July 2022 the Negotiating Framework for the negotiations with Albania, in accordance with the revised enlargement methodology.

The justice system

The justice system governance institutions established in 2018 include the new HJC and the HPC, with the HJI being established in 2020. These institutions are fully functional and have now been functioning for almost 5 years. The self-governance institutions have continued to fully perform their functions. The HJC and HPC have partially renewed their membership to include both magistrates and lay members. Notwithstanding this fact, the priorities of the two Councils in exercising their respective constitutional competences are different for several reason

The EU Report on Albania 2022

The EU Report on Albania 2022, recommends: “further advance the process of re-evaluating judges and prosecutors (vetting) and, where possible, increase the pace of procedures with due regards to the quality of the process; consolidate efforts to enhance the efficiency and transparency of all courts and prosecution offices, including through fast and decisive action to set up a modern Integrated Case Management System and with the rollout of a solid implementation plan for the new judicial map; continue to consolidate the capacity of the judicial system and its self-governing institutions, while making quality and efficiency improvements at the School of Magistrates”.

PROFESSIONAL SKILLS

The expected Impact of the action is to contribute to the strengthening of the rule of justice system in Albania.

The overall outcome is to support the self-governance institutions (HJC, HPC and HJI) in Albania to implement the justice reform by strengthening their independence (via meritocracy and career), accountability transparency, efficiency in line with the EU acquis and best practices as well as to improve coordination and communication of the self-governance institutions (HJC, HPC and HJI) through the establishment of sustainable mechanism in line with the best European practices.
The Project is designed with the intention of achieving long term and sustainable results that would have a strong impact on the overall judicial reform that will lead Albania further towards EU membership. In order to achieve this goal, the Project Objectives and Results/Outcomes are developed based on the recommendations of EURALIUS V. The Project aims to ensure a coherent approach to EU technical assistance, building on the activities and achievements already obtained in the last 4 years as well as on the know-how of the former project.

Our Team

The implementation of the project has been entrusted to a team of professionals consisting of 10 members, under the direct responsibility of the Team Leader. The project has in its structure 4 Components which are led by a Key International Expert and each of them is assisted by a Senior national legal expert. Components 1, 2, and 3 respectively support one of the beneficiaries of the project, and Component 4 deals with all coordination and administrative issues of the project. Team Leader, in addition to the responsibilities related to the management of the entire project, also leads Component 2. The Key International Expert of Component 4 is also the Project Coordinator, who assists TL in the project implementation and all cross-cutting topics. Finance and Reporting Expert, Project Assistant, and the Driver are also an important integral part of the Project.
